Have you been in the USA for a long time?

It’s a possibility that you would be happily married there. If I’m correct, then you should take the gist of this blog into account.

Willing to know what it is? Well! It’s about the birth registration of a baby born to Indian parents in the USA. However, the perks of being a holder of the foreign citizenship are lucrative. But, you can’t turn blindfolded to the merits of the Indian citizenship. You have an alternative to retain your foreign citizenship. Yeah! You can obtain an OCI (Overseas Citizen of India) card. You will see the difference in visiting your home town.
It’s an ordeal for a foreigner to pass through the migration procedure. If your kid is born in the USA, he/she would be considered as a foreigner. But, you can attain for him/her a glitch-free traveling facility to India. Obtain a passport for him/her from this origin (India).
Problems to have a passport of the US:
It’s true that the NRI kid will not run up against so many hurdles in flying down here. But, his/her return to the USA would be a thorny path. A number of frictions would hamper his/her way at the USCIS office. It would:

  • Never offer a visa facility to the native of its own country. The baby born in the USA would have a birth right to be known as an American. Therefore, its immigration authority does not muddle visa processing for its own native.
  • Insist to get the passport of the USA. If the parents would agree, they have to give up their kid’s passport of the Indian nation. Dual citizenship is still not allowed in either of the country.

The parents with Indian passport can withdraw themselves out of the hot water. They can request the USCIS to issue an entry visa for their kid.
What does the Indian consulate say over the passport?
It definitely conveys the mandate of obtaining the Indian passport in parallel to the birth registration of the NRIs. If the parents ignore this mandate, their ward would be considered as an American. Since he/she would be born in that country and have no Indian passport, they would be a foreign citizen. It’s a norm. Now, the question is how they can register the birth so that they can get the Indian passport of their ward.
Documents required supporting birth registration application with Indian consulate:
First, they should have an idea of what documents they should submit where. It’s the Indian consulate office where the NRI parents can apply for their kid’s birth registration. They should have:

  • A self-attested declaration form.
  • Passport and its photocopy of the first two and last two pages (of both parents)
  • Passport of the foreign parent and his/her self-attested photocopy
  • Child’s birth proof
  • Marriage certificate of the parents
  • Residence proof
  • Visa

How can they register the birth of their kid with the Indian consulate?
As a mandate circulated in India, the NRIs should apply for the birth certificate of the US born baby within one year of the birth. They don’t need to pass through the hurdles and expenses of traveling. Rather, they can apply for it online by following these directions:

  • Visit the website of the MHA (Ministry of Home Affairs).
  • Go to the option that reads: Registration of birth of a minor child at an Indian Consulate under Section 4(1) of the Citizenship Act, 1955
  • Walk through all instructions carefully.
  • Hit the Apply Online tab.
  • A form will pop up. Fill it as per the given instructions to avoid mistakes.
  • Thoroughly check and then, submit the duly filled form.
  • Your request will be sent through the form submission. Subsequently, a registration file number will flash. Mark the stamp of acknowledgement by saving that file number.
  • Now, you need to upload the aforementioned supporting documents with the application form.
  • Take its soft copy by hitting the print tab. But it won’t comply with your request unless you enter the file number.
  • Once you would enter it, the PDF version of the form will emerge. Print it out.
  • Paste your kid’s snapshot on the hard copy of that form. Then, attest it by self.
  • Visit the Consulate office.
  • Verify all original and copies of your documents.
