It’s a critical situation when you need to provide your birth certificate and it’s not there. One cannot have the leverages that the government provides. The situation becomes really worse when you have to apply for the immigration or passport or green card.

 Certainly, only a birth proof in original can save your day. But, it’s missing or might not be registered before. 

 How to get it- Here is the way. 

One can apply for the NABC or Non-Availability of Birth Certificate. 

Get an NABC 

The NABC is a legal proof of unregistered birth. If the birth proof is torn or damaged due to any reason or being theft, an alternative birth proof is issued. This document is called the non-availability of birth certificate. Every birth requires to be registered within a stipulated time with the government agency. Some parents don’t make it happen. In that case also, this document is issued. 

There is a set up or governing authority to look into this matter in every country. The person who is authorised to do so is known as a “Registrar”. He sends a formal instruction to the government agency for finding an original copy of the birth certificate of the applicant. Once confirmed its absence, it issues the NABC. It is treated as an original birth proof. 

All government agencies accept it as a valid birth proof. So, one can easily get the passport, OCI card, immigration document and green card.

 Eligibility Guidelines for NABC

 Every place comes with different eligibility criteria for the issuance of NABC. There are some common guidelines that one needs to follow everywhere for getting this legitimate paper. 

  • The applicant must be born within the territorial jurisdiction of the country where he/she comes from.
  • Individual shouldn’t have any original birth proof issued by any government agency there.
  • There should be a gap of minimum one year between the date of birth of the applicant and the date of its issuance.

 Procedure  

It is essential to inform the local police station if the original birth certificate is missing. An FIR can help in getting through this procedure easily. Otherwise, one has to inform about his case to the local registrar. He guides on how to get the non-availability of birth certificateFollow his advice.

 Once informed, the verification will go on at the backstage in all government offices that maintain this record. If it finds no proof, the NABC is issued.

 The applicant has to fill up a form and enclose the below mentioned documents in its support. The Registrar verifies the details and then, issues it from the concerned office.

 Get an Affidavit 

An affidavit is a sworn statement issued by any A-grade gazette officer. Every country/town/ city/or state has this officer authorised to do so. He can issue the statement on the stamp paper being signed and stamped. It requires any proof of the birth, address and guardian. The officer verifies the details from those proofs before signing the document.

  • Letter issued by the Jail Incharge ( if born in the jail)
  • Letter issued by the head of the Dharmashala/ Boarding house (if one took birth there)
  • Letter issued by the vehicle incharge( if the birth occurred in the vehicle)
  • Letter issued by the headman of the village/incharge of the local police station(if one was found deserted in a public place
  • Letter issued by the authorized medical officer of the hospital/ nursing home/maternity ward where the applicant was born
  • School records, like school leaving certificate, mark sheets, matriculation certificate, degree certificate, 12thor 10thclass certificate that have the name & date of birth of the applicant
  • State of federal Census record, like ration card, with the name of the child and parents
  • Church record where one took baptism within two months of birth (having date of birth, state of birth, date of religious ceremony and the name of his/her parents)
  • Adoption decree( if the applicant is an adopted child) & other legal records of judicial proceedings
  • Voter card/ National Identity Card
  • Driving licence
  • Passport (current and surrendered)
  • Statement of two witnesses (that can be mother and father, relative, friend, neighbor or sibling

These two methods can help the applicant to get the original proof of the birth in a month.
